Terms and Conditions

In these Terms and Conditions:

• "We" / "us" / "Short-Post" – Biz-View, trading as Short-Post, KVK 99865017, Professor Holwerdalaan 70, 2672 LG Naaldwijk, Nederland.
• "Service" – the Short-Post web application, including all features: post scheduling, content idea generation, and pre-publish analysis.
• "User" / "you" – any natural or legal person who creates an account and uses the Service.
• "Account" – the personal environment you create to access the Service.
• "Workspace" – a contained environment within your account for managing one or more social media accounts.
• "Content" – all text, images, videos, hashtags, and other material you upload or create through the Service.
• "Subscription" – the chosen payment plan (Free, Pro, or Max).

By creating an account or using the Service you accept these Terms and Conditions and our Privacy Policy. If you act on behalf of an organisation, you warrant that you have authority to bind that organisation.

If you do not agree to these terms, do not use the Service.

These terms apply to all use of the Service, including free and paid subscriptions.

You must be at least 16 years old to create an account. By creating an account you confirm that you meet this requirement.

You are responsible for:

• Keeping your login credentials confidential
• All activity that takes place under your account
• Immediately reporting any unauthorised use to info@short-post.com

We are not liable for any loss or damage arising from unauthorised use of your account resulting from your own negligence.

Short-Post offers the following subscriptions:

Pro and Max include a 7-day free trial. No payment is required during the trial. After the trial ends, the chosen subscription is charged automatically unless you cancel before the trial expires.

We reserve the right to change features and subscription prices. Existing subscribers will be notified at least 30 days in advance of any price changes.

Payments are processed by Stripe. By starting a paid subscription you agree to Stripe's payment terms. We do not store any payment data (card details, bank account numbers) ourselves.

Subscriptions renew automatically at the end of each billing period (monthly or annually). You can cancel your subscription at any time via account settings. Cancellation takes effect at the end of the current billing period, you retain access to paid features until that date.

All prices include any applicable VAT unless stated otherwise. Invoices are sent by email.

As a consumer you have a 14-day right of withdrawal for distance contracts under EU consumer law (Dutch Civil Code Art. 6:230o). This right only lapses if you have explicitly given written consent to immediate delivery and waived the right of withdrawal, this requires an explicit checkbox in the checkout flow.

Because Pro and Max begin with a 7-day free trial, the first payment is only processed afterwards. You can cancel during the trial period at no cost; nothing is owed and the right of withdrawal is not relevant.

Outside the trial period we do not offer refunds for elapsed billing periods, unless required by law.

You may only use the Service for lawful purposes and in accordance with these terms. The following are prohibited:

• Using the Service to distribute illegal, harmful, misleading, hateful, or infringing content
• Uploading copyrighted material without the required rights
• Using the Service for spam, unsolicited communications, or automated abuse
• Attempting to circumvent or compromise the security, infrastructure, or other accounts
• Using the Service in a way that violates the terms of service of TikTok, Instagram, or YouTube
• Transferring your account or workspaces to third parties without our written consent
• Reverse-engineering, decompiling, or copying the Service

Violation of these provisions may result in immediate suspension or termination of your account without entitlement to a refund.

Your content: You retain all ownership rights to content you upload or create through the Service. By uploading content you grant us a limited, non-exclusive, royalty-free licence to process that content solely for the purpose of providing the Service (such as storing, processing for analysis, and forwarding to social media platforms via Bundle Social). We make no claim of ownership over your content.

Short-Post: All rights to the Service, the software, the Short-Post brand, logos, and other materials we have developed are owned by Biz-View. You receive a limited, personal, non-transferable right to use the Service in accordance with these terms.

AI-generated content: Content ideas and analysis results generated via the AI features are provided as inspiration only. We do not guarantee that AI-generated content is unique, free of third-party rights, or fit for your intended purpose. Responsibility for publishing content remains with you at all times.

The Service uses third parties to deliver certain features:

• Bundle Social – for publishing to TikTok, Instagram, and YouTube. Publishing is subject to Bundle Social's terms of service and the terms of the relevant social media platforms.
• Apify – for scraping public social media posts for content ideas.
• MindStudio – for AI-generated content ideas.
• Stripe – for payment processing.

We are not responsible for the operation, availability, or policies of these third parties. Outages or changes at third parties may affect the Service without giving rise to a refund or compensation claim.

Using TikTok, Instagram, and YouTube through the Service is also subject to those platforms' own terms. You are responsible for complying with them.

We aim for high availability of the Service but do not guarantee uninterrupted or error-free operation. Planned maintenance windows will be announced in advance where possible. We are not liable for damage resulting from temporary unavailability.

We reserve the right to modify, supplement, or discontinue the Service or parts of it at any time, provided users are notified in a timely manner.

To the maximum extent permitted by law, our liability is limited to the amount you paid us in the three months preceding the event giving rise to the claim.

We are not liable for:

• Indirect loss, consequential loss, loss of profit, or loss of data
• Loss caused by the acts or omissions of third parties (such as Apify, Bundle Social, MindStudio, or social media platforms)
• Loss caused by posts not being published or being published incorrectly via third parties
• Loss caused by unauthorised access to your account as a result of your own negligence

This limitation does not apply to liability that cannot be excluded by law, such as liability for intentional misconduct or gross negligence.

By you: You can cancel your account at any time via account settings. Upon cancellation, all your data is permanently deleted in accordance with our Privacy Policy.

By us: We may suspend or terminate your account with immediate effect if:

• You seriously or repeatedly breach these Terms and Conditions
• Payment consistently fails
• We are legally required to do so

Termination for your breach of these terms does not entitle you to a refund of any prepaid amounts.

These Terms and Conditions are governed by Dutch law. Disputes will be submitted to the competent court in the district of The Hague, unless mandatory law requires otherwise.

We will first attempt to resolve any dispute through mutual consultation. Contact us at info@short-post.com.

We may update these Terms and Conditions from time to time. For material changes you will receive an email notification at least 14 days in advance. Continued use after the effective date constitutes acceptance of the updated terms. If you disagree with the changes, you may cancel your account free of charge before the effective date.
